COVID-19 : NOVEL CORONAVIRUS

Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand. 


This update is provided on a weekly basis.


LEGISLATION CHANGES

Coronavirus Economic Response Package (Payments and Benefits) Amendment Rules (No. 9) 2020

  • Amends the Coronavirus Economic Response Package (Payments and Benefits) Rules 2020 to establish the JobMaker scheme and specify details about the scheme.

Defence Determination, Conditions of service (COVID-19 response) Amendment Determination 2020 (No. 21) 

  • Expands certain benefits that have been provided in response to the COVID-19 pandemic and provides additional benefits to meet the ongoing needs to the ADF workforce during this period.

JobMaker Hiring Credit Reporting Obligations Instrument 2020 

  • Describes information that must be reported under the JobMaker Hiring Credit scheme, including the information that must be reported each time a claim for a payment is made under the scheme.

Therapeutic Goods (Medical Devices - Information that Must Accompany Application for Inclusion) Amendment (COVID-19 Measures - Class 1 IVD Medical Devices) Determination 2020 

  • Specifies that a declaration of conformity made by a manufacturer under clause 6.6 of Schedule 3 to the Therapeutic Goods (Medical Devices) Regulations 2002 must accompany an application for inclusion in relation to a Class 1 in vitro diagnostic (IVD) medical device.


Public Health (Restricted Activities - Gatherings, Business or Undertakings) Emergency Direction 2020 (No 14) 

  • Restricts non-essential gatherings and the operation of non-essential businesses and undertakings in order to limit the spread of COVID-19.


Public Health (COVID-19 Restrictions on Gathering and Movement) Order (No 7) 2020 

  • Revokes and remakes, with some changes, the Public Health (COVID-19 Restrictions on Gathering and Movement) Order (No 6) 2020.

Public Health (COVID-19 Sydney New Year's Eve Arrangements) Order 2020 

  • Imposes certain restrictions concerning gatherings for the purposes of the celebration of 2020 New Year’s Eve in Sydney.


COVID-19 Emergency Response and Other Legislation Amendment Act 2020 

  • Extends the operation of COVID-19 related legislation, among other things.


Public Health Act 1997 - Section 15 Extension of Emergency Declaration 

  • Extends the public health emergency declared on 17 March 2020 for twelve weeks commencing on 21 November 2020


Border Crossing Permit Scheme Directions (No 2) 

  • Prevents certain persons from entering Victoria from South Australia, and requires certain persons from South Australia to carry a permit when entering Victoria - came into force at 11.59 pm on 6 December 2020.

Care Facilities Directions (No 18) 

  • Provides for restricted access to care facilities to limit the spread of COVID-19 within a particularly vulnerable population - came into force at 11:59 pm on 6 December 2020.

Diagnosed Persons and Close Contacts Directions (No 14) 

  • Requires persons diagnosed with COVID-19 to self-isolate, and persons living with a diagnosed person to self-quarantine - came into force at 11:59 pm on 6 December 2020.

Extension of the Declaration of State of Emergency 

  • Extends the declaration of a state of emergency made on 16 March 2020 until 11:59 pm on 3 January 2021.

Food Amendment Act 2020 

  • Enables the Secretary to require councils to pay a charge for any use made by them of an online portal for the registration of food premises, amends provisions relating to food safety programs, and prescribes further infringement offences and infringement penalties (among other things).

Hospital Visitor Directions (No 16) 

  • Prohibits certain visits to hospitals to limit the spread of COVID-19 - came into force at 11:59 pm on 6 December 2020.

Order Establishing COVID-19 Quarantine Victoria as an Administrative Office 

  • Establishes COVID-19 Quarantine Victoria as an Administrative Office in relation to the Department of Justice and Community Safety.

Restricted Activity Directions (Victoria) (No 3) 

  • Restricts the operation of certain businesses and undertakings in Victoria - came into force at 11.59 pm 6 December 2020.

Stay Safe Directions (Victoria) (No 4) 

  • Requires residents of Victoria to wear face coverings and limit their interactions with other by restricting gatherings - came into force at 11.59 pm on 6 December 2020.

Workplace (Additional Industry Obligations) Directions (No 14) 

  • Established additional specific obligations on employers and workers in specific industries in relation to managing the risk associated with COVID-19 - came into force at 11.59 pm on 6 December 2020.

Workplace Directions (No 12) 

  • Limits the number of Victorians attending work premises to assist in reducing the frequency and scale of COVID-19 outbreaks and establish more specific obligations on employers and workers - came into force at 11:59 pm on 6 December 2020.


Extension of State of Emergency Declaration 

  • Extends the state of emergency declaration made on 15 March 2020 for fourteen days


COVID-19 Public Health Response Amendment Act (No 2) 2020

  • Amends the COVID-19 Public Health Response Act 2020 in relation to COVID-19 orders and cost recovery.
